Pocket Money is a financial technology platform that enables individuals to receive, hold, convert, and spend US Dollars across borders. The Services are designed to make USD access simpler, more secure, and more flexible for personal financial use worldwide. These Terms of Service (“Terms”) outline the legal agreement between you and Pocket Money Ventures, Inc. (“Pocket Money,” “We,” “Our,” or “Us”) and govern your access to and use of the MyPocket.Money website, mobile applications, and related services (collectively, the “Services”).
Please carefully read these Terms, along with our Privacy Policy, together these documents form a single binding agreement between you and Pocket Money (the “Agreement”).
By accessing or using the Service you acknowledge that you have read,
understood, and agree to be bound by this Agreement. From time to time, We
may update these Terms. When We do, We will post the revised version with a
new “Last Updated” date at the top of this page.
Continued use of the Services constitutes acceptance of the updated terms. If
you do not agree to this Agreement, please stop using or accessing the
Service.
NOTICE REGARDING ARBITRATION: WHEN YOU AGREE TO THIS AGREEMENT, YOU ARE AGREEING TO RESOLVE DISPUTES BETWEEN YOU AND POCKET MONEY THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW CAREFULLY.
By using the Services, you confirm that you are at least 18 years old and meet the minimum age of digital consent in your country. If you do not meet this requirement, you must stop using the Services immediately.
To access the Services, you will be asked to provide certain registration details to create a user account. All personal data that you provide to us to create a user account or through the use of any of the features within the Services is governed by our Privacy Policy. The information that you provide must be accurate, complete, and current.
You are solely responsible for keeping your account credentials secure and confidential. You agree not to share your login or allow anyone else to access the Services through your account, and you accept full responsibility for any use of and all activity on your user account, whether or not authorized by you.
Pocket Money is not liable for any loss, damage, or unauthorized activity that you may incur as a result of the activity on your user account. You agree to notify us immediately of any unauthorized access, use, or other security breach involving your account.
To help keep the platform secure and comply with regulatory requirements, Pocket Money requires users to verify their identity during account creation. This may include uploading a valid government-issued ID, taking a real-time selfie to confirm the ID belongs to you, and/or providing personal information, such as your full name, date of birth, or address, for verification purposes.
By signing up, you authorize Pocket Money to verify your identity using the information you provide through trusted third-party providers. This may involve checking your details against official databases or public records. If we’re unable to verify your identity, or if the information is incomplete or inaccurate, we may not be able to open your account or grant access to the Services.
Pocket Money may, at its sole discretion, modify, enhance, or discontinue any
part of the Services at any time to improve functionality, comply with legal
requirements, or maintain effective operations. While we strive to provide
reliable and continuous access we do not guarantee uninterrupted service,
flawless performance, or the complete accuracy of information presented
through the Services. Certain features may rely on third-party integrations
or user-provided data, which can occasionally result in delays, inaccuracies,
or errors.
Periodic downtime may occur due to scheduled maintenance, updates, or
unforeseen technical issues.
Subject to your compliance with these Terms, Pocket Money grants you a limited, non-exclusive, non-transferable right to access and use the Services. This right is granted solely to you and may not be shared, sublicensed, sold, or otherwise transferred to anyone else. You are responsible for maintaining the security of your account and ensuring your use remains in full compliance with this Agreement.
By using the Services, you may submit, or store certain data through your account (“User Content”), such as personal financial information, transaction notes, recipient details, or account-related information. You are solely responsible for ensuring that all User Content you provide is accurate, lawful, and appropriate. By submitting User Content, you represent and warrant that it does not violate any applicable laws or the rights of any third party, including intellectual property or privacy rights.
Pocket Money does not claim ownership of your User Content. However, you grant us a limited license to use, process, store, and display that content solely to operate, maintain, improve, and provide the Services. We reserve the right to remove or restrict any User Content that we believe violates these Terms, applicable law, or the rights of others
You agree to use the Services only for lawful purposes and in full compliance with all applicable local, state, national, and international laws and regulations. You may not use the Services in any way that is not expressly permitted by these Terms or that could harm Pocket Money, its users, or third parties.
You are prohibited from using the Services to:
Pocket Money reserves the right to monitor your use of the Services to ensure compliance with these Terms. We may suspend or terminate your account and access to the Services at any time, with or without notice, if we believe you have violated these Terms or engaged in any activity that could result in harm or legal liability.
Any trademarks and service marks, trade dress, copyright-protected works, rights of publicity, patents, know-how, trade secrets, proprietary ideas, and publicity rights that are reproduced, distributed, displayed, performed, transmitted, or otherwise appear in the Services or any content therein (collectively, “Pocket Money IP”) are property of Pocket Money, its licensors, or other providers of such material. Other than as expressly allowed by us in writing, nothing herein or in the Services may be implied as granting any license, assignment or right to copy or use Pocket Money IP without prior authorization.
When converting funds between US Dollars (“USD”) and Pakistani Rupees (“PKR”), We apply the mid-market exchange rate at the time of your transaction. The mid-market rate represents the midpoint between global buy and sell rates and does not include any markup or spread from Us.
While we aim to present accurate and real-time exchange rates, the rate you receive may vary slightly due to market fluctuations, third-party processing delays, or the timing of transaction completion. You will always see the applicable exchange rate before confirming a conversion.
Some Services rely on third-party providers, including card issuers, payment processors, and local banking partners. These third parties may charge separate fees for deposits, withdrawals, cross-border transactions, or currency conversions. We do not control or benefit from these third-party fees, and you are solely responsible for reviewing and understanding any additional charges that may apply.
We reserve the right to withhold, delay, or reverse any payout or transaction if We believe it may violate applicable laws, these Terms, or pose a risk to you, other users, or the platform. In the event of a failed, disputed, or reversed transaction involving your account, We may investigate and take appropriate action, including adjusting your balance or temporarily limiting access to your account. Misuse of the Services or repeated violations may result in suspension or termination of your account.
Pocket Money relies on third-party service providers, including but not limited to payment processors, card issuers, banking institutions, currency exchange providers, and other financial intermediaries (“Third Parties”) to facilitate certain aspects of the Services. While we select and partner with reputable providers, we do not control, and are not responsible for, the acts, omissions, availability, or performance of these Third Parties.
By using the Services, you acknowledge and agree that any delay, error, dispute, or failure related to payments, transfers, currency conversions, card usage, or other functionality facilitated by these Third Parties is solely the responsibility of the relevant Third Party, and not of Pocket Money. We do not assume any liability for losses, damages, or claims arising from the use of or reliance on Third Party services, even where those services are accessible through or integrated into our platform.
This Agreement begins on the date you first access or use the Services and remains in effect until either you or Pocket Money terminates it in accordance with these Terms (the “Term”).
We may suspend or terminate your access to the Services at any time, with or without notice, if We believe you have violated these Terms, engaged in prohibited or unlawful conduct, or used the Services in a way that creates legal, operational, or financial risk to Us, our users, or third-party partners. We may also suspend or terminate your access to comply with legal obligations, financial regulations, or at the request of payment providers or regulatory authorities.
If your account is terminated, your access to the Services will be disabled and you are no longer authorized to use Pocket Money. Any transaction fees already paid are non-refundable, and you remain responsible for any outstanding charges related to prior activity.
If you hold a balance in your USD wallet or have funds pending through a linked financial account, we will make reasonable efforts to return any eligible remaining funds, subject to applicable laws, fraud and compliance reviews, and the terms of our third-party payment partners. We also reserve the right to withhold or restrict access to funds in cases of suspected fraud, legal holds, or violations of these Terms.
Termination does not affect provisions that are intended to survive, including but not limited to provisions related to intellectual property, disclaimers, limitations of liability, indemnification, and compliance with legal requirements.
POCKET MONEY AND ANY PERSON ASSOCIATED WITH POCKET MONEY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. DOES NOT GUARANTEE THAT YOU WILL BE ABLE TO SUCCESSFULLY RECEIVE, HOLD, CONVERT, OR TRANSFER FUNDS AT ANY GIVEN TIME OR WITHOUT INTERRUPTION. POCKET MONEY IS NOT RESPONSIBLE OR LIABLE FOR THE PERFORMANCE, AVAILABILITY, OR ACCURACY OF ANY THIRD-PARTY SERVICES OR PLATFORMS THAT MAY BE INTEGRATED WITH OR USED IN CONNECTION WITH THE SERVICES, INCLUDING PAYMENT PROCESSORS, CARD ISSUERS, CURRENCY CONVERSION PROVIDERS, OR BANKING NETWORKS. WE DO NOT GUARANTEE THE CONTINUED AVAILABILITY OF SUCH THIRD-PARTY SERVICES AND MAY MODIFY OR DISCONTINUE ANY INTEGRATION AT ANY TIME IN OUR SOLE DISCRETION. POCKET MONEY MAKES NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS, (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.
YOU ACKNOWLEDGE AND AGREE THAT WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOSS OF USE, GOODWILL, DATA, OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, REGARDLESS OF THE CAUSE. OUR TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE 12 MONTHS PRECEDING THE CLAIM.
YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICES. IN THE EVENT THAT YOU CAUSE HARM TO A THIRD PARTY OR BECOME INVOLVED IN A DISPUTE, WE SHALL NOT PARTICIPATE NOR ASSUME ANY LIABILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY AND HOLD US, OUR AFFILIATES, AND PERSONNEL HARMLESS FROM ANY COSTS, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING FROM THIRD-PARTY CLAIMS RELATED TO YOUR USE OF THE SERVICES OR ANY BREACH OF THESE TERMS.
By entering in this Agreement, You agree that in the event a dispute, controversy, or claim arises out of or relating to these Terms (“Dispute”), the Dispute will be resolved by binding arbitration rather than in court and waive any right to participate in a class action lawsuit. The parties will first try in good faith to settle any Dispute within 30 calendar days after the Dispute arises. If the Dispute is not resolved within 30 calendar days, it shall be resolved by binding arbitration by the American Arbitration Association’s International Centre for Dispute Resolution in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in San Francisco County, California, USA. By agreeing to mandatory arbitration as set forth herein, You and Pocket Money knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or counterclaim, except that either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement. The arbitral award will be final and binding on the parties and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property.
Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.
This Agreement will be governed by the laws of the State of California, USA, without reference to conflict of law rules. All disputes will be governed by the arbitration agreement above.
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, (“Force Majeure Event”) including earthquake, flood, or other natural disaster, act of God, labor controversy, civil disturbance, terrorism, riots, or war.
This Agreement does not create any association, agency, partnership, employment, or joint venture between the parties hereto, or be construed to evidence the intention of the parties to establish such a relationship. Neither party will have the authority to obligate or bind the other in any manner, and nothing herein contained will give rise or is intended to give rise to any rights of any kind to any third parties.
No waiver by us of any term or condition set forth in this Agreement shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under this Agreement shall not constitute a waiver of such right or provision.
If any provision of this Agreement is deemed to be invalid, void, or otherwise unenforceable by any court or arbitrator of competent jurisdiction, for any reason, that provision will be limited or severed to the extent necessary so that the Agreement will otherwise remain in full force and effect.
This Agreement does not confer any benefits on any third party unless it expressly states that it does.
